The Company wishes to employ the Seasonal Employee, and the Seasonal Employee wishes to accept seasonal employment with the Company, on the terms and conditions set forth in this job offer. It is therefore agreed as follows
1. Employment. The Company shall employ the seasonal employee, and the seasonal employee shall serve the company as employee - with such duties and responsibilities as may be assigned to the employee by the President of Company or supervisory management personnel and as are normally associated with a position of that nature. The employee shall devote his/her best efforts and all of his/her business time to the performance of these duties under this agreement and shall perform them faithfully, diligently, and competently and in the manner consistent with the policies of the Company. The employee shall not engage in activities outside the scope of this employment if such activities would distract from interfere with the fulfillment of this responsibilities or duties under this agreement or require substantial time or services on the part of the employee. The company shall have a right to offer to seasonal employee another positions available at the time.
2. Evaluation period. The first seven (7) days of employment is evaluation period. During this time a manager will continuously evaluate the employee's performance, attendance, attitude and conduct to determine compatibility with the requirements of the position. Should an employee's performance, attendance, attitude, or conduct not meet the standards, they will be released from employment.
3. Term of employment . The seasonal employee's employment by the company under this Job offer shall commence on the date of signed this Job Offer and, subject to earlier termination pursuant to section 1 and 5 or unsatisfactory performance during evaluation period, shall terminate 7 (seven) days before visa expiration day. In case the Seasonal employee decides to willfully terminate this agreement before work visa expires, the Employee will have to pay the early termination fee in the amount of $500
4 . Compensation
As full compensation for all services rendered by seasonal employee to the Company under Seasonal employment agreement, the Company shall pay the seasonal employee compensation $8+ hour , minimum 40 hours a week.
5. Housing:
A) Initial housing will be in shared apartments furnished with beds, tables, and chairs. Housing will be in shared dormitory/hotel room style accommodations. Each tenant will share a room with 2 to 4 other people.
B) Before the seasonal employee can be accommodated, he/her has to provide a receipt of paid security deposit or pay the $250 security deposit at the time of arrival to US.
C) Rent payment also should be paid upon arrival in amount $10per day for 30/31 day advance. Rent payment depends of amount of roommates in 1 room.
D) Security deposit refundable ONLY after completion of this agreement, following all roles and regulations and policies of the Company.
E) In case if seasonal employee will terminate this agreement willfully or this agreement becomes a subject to early termination pursuant to section 1 or 5, then the Company withholds the security deposit ($250) and early termination fee ($500). Both amounts will be deducted from a seasonal employee paycheck or Employee will pay by himself. The employee has to leave the premises, arranged by the Company for its employee, within two (2) days after the employment has been terminated.
6) Transportation.
Transportation will be provided to and from training or work and only if a seasonal employee resides in the housing arranged by the Company for a cost of $20.00 a week. In case if seasonal employee does not resides in arranged By Company housing, it's becomes an employee responsibilities to arrange his/her own transportation.
7) Expenses.
The following expenses can be deducted from Seasonal employee's paychecks:
A) Housing expenses, including but not limited to rent, security deposit, utilities (electricity, water, sewage, etc).
B) The cost of fixing or replacing items that could be broken or any other damages during the seasonal employee stay in the housing arranged by the Company.
C) The cost of transportation, including but not limited to transportation to and from work, additional transportation services, airport or bus station shuttles, etc.
D) The seasonal employee understands and agrees that there is going to be an additional living cost and expenses and they should have enough money to support themselves before getting first paycheck plus they must have money to pay security deposit and first month rent.
Based on Company experience the amount we suggest to have is about $1,000
E) The Company is enforcing a Violation Ticketing system: including but not limited to breach of agreement or any other possible violations of Company rules and regulations and policies.
8. Disability or Death
A) If, as a result of any physical or mental disability, the Employee shall have failed or is unable to perform his/her duties for a period of thirty (30) consecutive days, the Company may, by notice to the Employee subsequent thereto, terminate his/her employment under this Agreement as of the date of the notice without any further payment or the furnishing of any benefit by the Company under this Agreement (other than accrued and unpaid base salary and commissions and expenses and benefits which have accrued pursuant to any plan or by law).
B) The term of the Employee's employment under employment Agreement shall terminate upon his death without any further payment or the furnishing of any benefit by the Company under this Agreement (other than accrued and unpaid base salary and commissions and expenses and benefits which have accrued pursuant to any plan or by law).
9. Termination
The Company shall have the right to terminate this Agreement and the Employee's employment with the Company for cause. For purposes of this Job Offer and the Employment Agreement term “cause” shall mean:
• Any breach of the Employee's obligations under the Employment Agreement;
• Fraud, theft, or gross malfeasance on the part of the Employee, including, but not limited at the conduct of a felonious or criminal nature, conduct involving moral turpitude, embezzlement or misappropriation of assets and/or seeking another employment from another source, outside From the Employer;
• The habitual use of drugs or intoxicants to an extent that it impairs the Employee's ability to properly perform his/her duties;1
• Violation by the Employee of his obligations to the Company, including, without limitation, conduct which inconsistent with the Employee's position and which results or is reasonably likely to result (in the opinion of the Management of the Company) an adverse effect (financial or otherwise) on the business or reputation of the Company or any of its subsidiaries, divisions or affiliates.
• The Employee's failure, refusal, or neglect to perform his duties contemplated herein within a reasonable period under the circumstances after written notice from the Management of the Company, describing the alleged breach and offering the Employee a reasonable opportunity to cure same;
• Repeated violation by the Employee of any of the written work rules or written policies of the Company after written notice of violation from the Management of the Company.
• Breach of standards adopted by the Company governing professional independence or conflicts of interest (second job can be obtain only through Employers or by employer written permission).
If the employment of the Employee is terminated for cause, the Company shall not be obligated to make any further payment to the Employee (other than accrued and unpaid bas salary and commission and expenses to the date of termination), or continue to provide any benefit (other than benefits which have accrued pursuant to any plan or by the law) to the Employee under this Agreement. In case of early termination of this Agreement by employee or if the Employee will live without any notice, the Employer will notify the appropriate government agencies and legal action may be taken by those government agencies and it's became Employee sole responsibilities to deal with the consequences of their action.
10. Miscellaneous
A) The Employment Agreement shall be governed by and construed in accordance with the laws of the State of Florida, and shall be construed without regard to any presumption or other rule requiring construction against the party causing the Agreement o be drafted.
B) This Job Offer contains a complete statement of all the arrangements between the Company and the seasonal employee with respect to its subject matter, and cannot be modified, amended, or terminated orally. Amendments may be made to this Agreement at any time if mutually agreed upon in writing.
C) The failure of a party to insist upon strict adherence to any term of Employment Agreement on any occasion shall not be considered a waiver or deprive that party of the right thereafter to insist upon strict adherence to that term or any other term of the Employment Agreement. Any waiver must be in writing.
D) Each of the parties irrevocably submits to the exclusive jurisdiction of any court of the State of Florida , sitting in Orange County of the Federal District . Court of Federal District over any action, suit, or proceeding relating to or arising out of this Agreement. On the transactions contemplated hereby, EACH OF THE PARTIES IRREVOCABLY AND UNCONDITIONALLY WAIVES THE RIGHT TO A TRIAL BY JURY IN ANY SUCH ACTION, SUIT, OR PROCEEDING. Each party hereby irrevocably waives any objection, including, without limitation, any objection to the laying of venue or based on the grounds of forum non convenient which such party may now or hereafter have the bringing of any such action, or proceeding in any such Court and irrevocably agrees that process in any such action, suit or proceeding may be served upon that party personally or by Certified or Registered Mail, Return Receipt Request.
E) The invalidity or unenforceability of any provision of this Employment Agreement, whether in whole or in part, shall no in any way affect the validity and/or enforceability of any other provision contain herein. Any invalid or enforceable provision shall be deemed severable to the extend of any such invalidity or unenforceability. It is expressly understood and agreed the Company and Employee considered the restrictions contained in this Employment Agreement reasonable for the purpose of preserving for the Company the good will, other proprietary rights and intangible business value of the Company, if a final judicial determination is maid by a Court is having jurisdiction that the time or territory or any other restriction contained in this Employment Agreement is an unreasonable or otherwise enforceable restriction against the Employee, the provisions of such clause shall not be rendered void but shall be deemed amending to apply as to maximum time and territory and to such other extent as such Court may judicially determine or indicate to be reasonable.
F) This Agreement is not assignable by either party except that it shall inure to the benefit of and be binding upon any successor to the Company by merger or consolidation or the acquisition of all or substantially all of the Company's assets, provided such successor assumes all the obligations of the company, and shall inure to the benefit of the heirs and legal representatives of the Employee.
